A land to give away  Reply with quote

How to get rid of a worthless land property in a resort community?

I have been trying to sell a piece of land in a West Virginia resort community – with golf course and everything. I lowered the listing price to $5500 but no buyers. I tried to give it away to charity -- no takers, probably due to the fact that the liability that goes with it was too high: $114/month due to the Property Owners Association, and about $556/year tax to the county government based on an assessment value of $22,380 (2015).

I wonder if I will be held hostage to this worthless land for the rest of my life.

Is there any legal and reasonable way I can be liberated from this liability?

If you just walk away, will it be seized for tax liens and sold at auction or will the Association foreclose, thus taking it off your hands? Research this on your own. Ask a lawyer only when you think you know the answer and need confirmation.

Thanks for the suggestions. The county has already put liens on it but has not been able to sell it for two years. The association is still collecting the dues and have gone through collection once (settled). Obviously they rather not take that piece of useless land. (putting a lien on something worthless is not helpful to them) Crying or Very sad I wonder when this can end.

Have you asked a lawyer? Actually, my friend is also facing the same issue. He referred to this website on someones recommendation. And I hope all this ends soon!

I've seen some TV ads lately that claim that they will take your Time Share off of your hands - you might try one of them - The situation is nearly the same as yours. The owners are stuck with the loan, the annual maintenance fee, etc - and can't sell the property.

I was on a church finance committee years ago - the church would not accept Time Share "gifts". (It would be a near-zero value on the books, plus an annual cost. Ie, not a gift, an expense.

Thanks for your comments and suggestions. I have contacted a lawyer in the state where the property is located. He suggested me to contact the neighbors to see how they are doing I have actually wrote to the owners of the immediate neighbors, asking them if they would like to take my land so that they could double the size of their land. No response. Perhaps I should hire a local lawyer to do something.

I agree. Land can be a very tricky thing. Also the fact you are giving it away may cause suspicion, which makes it harder to get rid off.
