Girlfriends sister went crazy with her credit card !!!! |
|
|
Hi my girlfriend is in a situation that I do not know how to get her out of, I am hoping you guys can help. A couple months ago my girlfriend's sister ( age 19) moved out into an apartment. She still had the credit card my girlfriend had gave her. The credit card has her sisters name on it but the main account holder is my girlfriend, so shes responsible for it. But heres the deal, her sister had went and got plastic surgery and charge 4800 dollars on it. My girlfriend freak out and her sister promise to pay 500 a month until the balance is due. She paid for like a month and now she hasn't paid in two months and I am sure this is hurting my girlfriends credit more and more. We ask her to get some new credit card in her own name and do a balance transfer but she said she has been decline for all of them. Now my question is their must be another way for her sister to have the debt or something so it is out of my girlfriends name. I mean any option will do, hell I even suggest getting a lawyer to draft something up that will make her sister fully responsible for that debt, is there such a way? Please help !!!

This is a good lesson learned. Your girlfriend is 100% responsible and can be sued and forced to pay, whether she made the charges or not.
You can take her to court...but that still won't force her to pay, just give you a judgment against her which you then have to figure out how to collect on. The balance transfer is an option but odds are good she won't get one.
Your girlfriend needs to continue to pay unless she wants her credit trashed. And, if she hasn't already, your GF needs to remove her from the card as an authorized user.

You can try to 'convince' your girlfriends sister to trasfer the debt to her accounts but as coaster said, it's unlikely.
If your girlfriends name is on it then legally she will be responsible for it.
It is not smart to play it safe but it is safe to play it smart.

your girlfriend is on the hook, it is HER account and that is all that matters, the rest is irrelevant.
There is a reason why your girlfriend's sister is not getting credit elsewhere.
Pay the remaining $4300 and consider it an expensive lesson learned.

The best option is for your girlfriend to somehow come up with the money and pay off the debt as soon as possible - it's quite obvious that her sister is not going to take responsibility for this debt before it hurts your girlfriends credit file permanently, so unfortunately, seeing as the card is in her name it really is up to her to get it paid off - no matter who did the spending.
Once she has done this there is the matter of your sisters girlfriend paying her back, which no doubt will be hard but at least it will no longer have any legal or credit related implications.

Like the above posters said, she is stuck with the debt because it is in her name. She need talk to the credit card company and tell them the situation. They can set up a payment plan to slowly pay off the money, without killing you with interest and fees.
You should also try to negotiate to pay off the whole debt to remove the negative credit listing. You are right her credit report is probably getting ruined also. She can dispute it to the credit bureaus, but should wait until it is taken care of first with the credit card company. Here is an article on removing errors off your credit report. Good luck.
