Is a one year old personal check still good? |

Hi,
Please help an ignorant soul:
I wrote a personal check for 3500.00 usd 11 months ago.
The person called me today and said that he just found the check and went by the bank and there's insufficient funds.
Is this acceptable? Or am I right to be a bit put off?

Under the Uniform Commercial Code, banks are not obligated to pay checks more than 6 months old.
It was neglectful of the payee to have misplaced it. But does this affect your willingness to issue a replacement check and deposit sufficient funds to cover its presentment? (You have had use of the money all this time.)

Oh yeah, that's totally inconsiderate!
What kind of slacker sits on a 3500 check for a year? I'd ask them to pay the penalties and let their response determine whether or not to conduct business with them in future dealings.
Or if it's a freind/family they at least should have to suffer through some form of mild/humorous abuse. Need an idea? Heheh:
write the amt of the check on a piece of masking tape. Attach that piece of tape under their mouse so that it's invisible. It will stop the mouse from working (optical or ball, doesn't matter). They will go through much hassle and worry. Eventually, they will figure it out and see the tape and associate the amount with their computer trouble. Run! LOL
You may even want to be elsewhere while they struggle with their "broken" computer, lest you bust out laffing and give away the gag.
